Mark Zuckerberg’s namesake has filed a lawsuit against the Facebook founder as the social media site constantly accuses him of ‘impersonating’ the billionaire.

The court documents in this case are sure to make lawyers heads hurt, given that both parties share the same moniker.

Mark S Zuckerberg, a bankruptcy attorney from the US state of Indiana, claims that the Facebook account for his law firm has been disabled five times over the last eight years.

On top of that, his personal account has been put in ‘Facebook jail’ on four separate occasions too over this period.

But he’s not just kicking up a fuss because this has stopped him from seeing his friends status updates – it’s because it’s costing him thousands in lost business.

Zuckerberg says he has been stuck in this cycle with Facebook for over a decade, but the final nail in the coffin came when $11,000 (£8,113) of his hard-earned money went down the toilet.

He’d forked out the cash to advertise his law firm on the social media site, only for the page to be suspended once again.

“It’s not funny,” Zuckerberg told WTHR-TV. “Not when they take my money. This really p***ed me off.

“It’s like buying a billboard on the side of the highway, paying the people for the billboard and then they come and put a giant blanket over it.

“You don’t get the benefit of what you pay for. It’s not fair, it’s not right and it needs to stop.”

The lawyer said he has grown sick and tired of Facebook accusing him of ‘impersonating a celebrity‘ and ‘using a false name’ every few months.

He explained that he has submitted his photo ID, credit cards and various images of his face in a bid to prove he isn’t trying to parody the Meta CEO.

The US man declared that he has had the name ‘way longer than’ the 41-year-old billionaire – and when his law career began 38 years ago, the other Zuckerberg was just a toddler.

Zuckerberg fumed: “I’ve got better things to do than sue Facebook. They’ve got more money, more lawyers, more resources than I do.

“I’d rather not pick a fight with them, but I don’t know how else to make them stop. I don’t know how else to get their attention.”

He claimed it took over six months for his account to be reinstated the last time it was flung into ‘Facebook jail’.

Zuckerberg filed a lawsuit in Marion Superior Court against Facebook’s parent company Meta, accusing it of negligence and breach of contract for suspending his accounts for baseless and improper reasons.

Among other demands, he is seeking a refund from Meta for the $11,000 he lost and for the firm to fork out for his attorney fees.

However, he said he wouldn’t turn down a trip on the tech titan’s superyacht if he offered it to him by way of apology, as he admitted: “If he wants to fly here personally and say I’m sorry or maybe let me spend a week on his boat to say I’m sorry, I’d probably take him up on that.”

The lawyer also told the New York Post that he can’t believe a company like Meta – which is ‘supposed to be so tech savvy’ – hasn’t found a way to resolve this issue.

“Normally you would say, well, it’s just Facebook and it’s not a big deal, but this time it’s affecting my bottom line because I was paying for advertising for my business to try and get clients,” he said.

“So they took my money, but then after they took my money, they shut me down for what they say is impersonating a celebrity, not using a true name and violating their community standards.

“And it’s the same message I get every time they shut me down. It’s like they’re almost doing it on purpose. But I’m sure they’re not, but it feels like it.”

A spokesperson for Meta told the outlet that they have received Zuckerberg’s complaint and are reviewing it, while stating that the lawyer’s account has also been reinstated.

“We know there’s more than one Mark Zuckerberg in the world, and we are getting to the bottom of this,” the statement said. “We have reinstated Mark Zuckerberg’s account, after finding it had been disabled in error.

“We appreciate Mr. Zuckerberg’s continued patience on this issue and are working to try and prevent this from happening in the future.”
